In the following, we let you have a short summary of popular questions in regard to trademark law on a European Union level with respective answers (for more detailed information to your very case, just contact us):

How do I register a brand in the European Union (EU)? How do I register my brand in Europe?

If you have a contact address in the European Union you may theoretically try to register the trademark yourself at the European Trademark Office in Alicante (precisely, the European Union Intellectual Property Office (EUIPO)). However, if you require professional assistance to avoid potential (expensive) mistakes it may be recommendable to entrust IP professionals like us (e.g. a European Patent, Trademark and Design Attorney, Patent Lawyer, IP Professionals or a Trademark Lawyer / Trademark Attorney).

How long does it take to register a trademark in the European Union? What is the duration of a EU trademark registration?

As the registration of a European Union trademark at the European Union Intellectual Property Office in Alicante (EUIPO) (“European Trademark Office”) has to be checked by a trademark examiner and each case may be different (e.g. in regard to the workload of the concerned examiner), there is no strict time frame when a trade mark is registered in the European Union. However, in a smooth case with no complaint or other provisional refusal, the duration from application to registration of a Union trademark at the EUIPO is ideally about 4 months.

Is there an accelerated trademark application in Europe for an express trademark registration at the EUIPO (“European Trademark Office”)?

Contrary to Germany, there is no possibility to pay additional official fees for an accelerated trademark application in the European Union available to get the trademark protection as fast as possible. However, there is the option to have a so-called fast track trademark application if you only use accepted wordings for the list of goods and services. This option saves effort for the trademark examiner and will therefore speed-up the registration procedure.

What is the fastest way to get a registered trademark for the Amazon brand registry as Amazon FBA trademark?

One of the fastest ways to get a trademark registration for the Amazon brand registry (e.g. an Amazon FBA trademark) is the filing of a German trademark and the selection of the accelerated proceeding.

How much does a EU trademark lawyer cost and what are the trademark lawyer fees in the European Union?

It cannot be stated per se how much a EU trademark lawyer cost and what are the trademark lawyer fees in the European Union (or elsewhere) as they primarily depend on the ordered trademark lawyer services, e.g. a trademark search in Europe, a trademark registration in the European Union (more precisely: a trademark application in the EU to get trademark protection in the European Union). When it comes to a EU trademark application the costs are normally separated between the official fees of the European Trademark Office in Alicante and the trademark attorney fees. On our website you can find additional information about these costs for a trademark registration in the European Union.

Do I have to use a Union trademark? Is there a use requirement for trademarks on a EU level?

Yes, you have to use a Union trademark in the European Union and there is a use requirement for trademarks in the EU. However, there is also a grace period for non-use of five years starting from the registration date. This means, that you have to use the EU trademark in a sufficient way in the European Union for the goods and services for which it claims protection.

What happens if I do not use a Union trademark?

If a Union trademark is registered for more than five years, a third party can file a cancellation request due to non-use at the European Union Intellectual Property Office and it will be necessary, that you give detailed proof of use of the trademark in the European Union (EU) in course of the proceeding to keep the trademark.
